УЕФА приостановил дисциплинарное расследование в отношении Барселоны, Ювентуса и Реала

УЕФА принимает к сведению принятое сегодня независимой Апелляционной инстанцией УЕФА решение о временной приостановке дисциплинарного дела в отношении "Барселоны", "Ювентуса" и "Реала" о возможном нарушении правовой базы УЕФА в связи с проектом так называемой "Суперлиги", сообщает официальный сайт УЕФА.

Решение о временной приостановке дела было принято Апелляционной инстанцией УЕФА после формального уведомления от 2 июня 2021 года от компетентных швейцарских органов. Данное уведомление касается судебного иска от 20 апреля 2021 года, поданного юридическим лицом European Super League Company SL в Мадридский коммерческий суд №17 ("Судебный приказ"). Решение независимой Апелляционной инстанции УЕФА было принято безотносительно правомерности Судебного приказа в Швейцарии. Упомянутые три клуба пытались защитить себя от возможных дисциплинарных санкций, относящихся к проекту так называемой "Суперлиги", отмечается в сообщении.

УЕФА понимает, почему дело необходимо приостановить, но сохраняет уверенность в своей позиции и продолжит защищать ее всеми возможными способами.

Легитимность дисциплинарных процедур в спорте с правом обжалования в Спортивном арбитражном суде давно признана необходимой для единообразного отправления правосудия в спорте. Европейский суд по правам человека, суды ЕС и Федеральный суд Швейцарии неоднократно выпускали постановления, что дисциплинарные/арбитражные правила оправданы законными интересами, связанными со спецификой спорта. Таким образом, УЕФА действовал в соответствии не только со своими уставом и регламентом, но и в соответствии с законодательством ЕС, Европейской конвенцией о правах человека и законодательством Швейцарии, начав независимое расследование поведения клубов, связанных с проектом так называемой "Суперлиги".

УЕФА предпримет все необходимые шаги в строгом соответствии с национальным законодательством и законодательством ЕС, чтобы Апелляционная инстанция УЕФА имела возможность возобновить данное дисциплинарное расследование как можно скорее, подчеркивается в заявлении.

Как сообщалось ранее, УЕФА и ФИФА не смогут применить санкции против Реала, Барселоны и Ювентуса.
